Why mediation?

Mediation is a fast, cost-effective and private form of dispute resolution and affords parties the opportunity to negotiate a creative, commercial solution. Parties also find mediation attractive because of its high success rate (typically over 80%).

What the Courts say about mediation

Importantly, Courts in England & Wales (and in jurisdictions around the world) expect parties to explore mediation or face the consequences of potential costs penalties. A settlement can be structured to include arrangements which could not be obtained from a Judge or Arbitrator.  If therefore the parties want an ongoing relationship, the ability to craft a remedy in mediation is often preferable to the blunt instrument of litigation or arbitration.

Mediation is the first resort in resolving disputes as it offers a private and confidential form of dispute resolution as well as flexibility (it can take place before or after Court/Arbitration proceedings have started).
